No. He can create noise but can’t implement non sense. Even here, carefully he has only restricted entry (just like last time coz that’s the only thing he can even try to pass). But even this will be challenged.

But if they had some brains, they should focus more of their energy in adjusting the prevailing wage. That’s can and should pass if done using correct methods.

 

But during his last term, their statistics methodology and logic was so flawed that even that simple thing got struck down.

Even for the people inside US, this is a travel ban. You have essentially been told you can't travel outside of the country, Indian on H1 on vacation outside need to come back of face a 100k hole.

H1b needed reform.

 

Like trump or not it was abused.

 

India and Indians should have no complaints.

 

However maga crowd thinking locals will be hired have another thing coming. Jobs will move overseas + ai.

What I have seen from immigration attorney's advisories in my firm & also in SM is they can deny ENTRY for non immigrants holding h1b unless 100k is paid. So they are advising everyone to return immaterial of your stamping status. The proclamation provides no exemptions based on your stamping status.

Most of these ‘immigration’ lawyers hired representing firms r overly cautious. But that’s not what his proclamation says.

this is not a reform this is rug pull, so you are saying a NRI who probably owns properties & investments in US, followed the laws & payed probably millions in taxes  to the US govt. for more than a decade just gets ransomed for 100k for daring to take a vacation because dear leader decided to upend his life with a days notice should have no complaints?

 

if India implemented laws like this, shutting out foreign investors, ppl will rightfully blame India for its regulations.

Don't really care what stuff he does with H1B visa, whether it is $1,00,000 annual fee for an H1B visa, or makes it double or triple. 

His country, elected by majority of Americans and it is upto him how he manages it. Headache for him and Americans not of Indians. This will not affect the Doctors in Mumbai by any ways. I guess people working in other professions in Mumbai or any other part of India also will be not worried about this H1B.  So let him do in US what pleases him. 

 

Likewise ruling party of country and State government (whichever they are and will be in future) of Maharashtra should continue with the roadmap and policies which have helped Mumbai grow the way it has grown albeit at faster pace.  Healthcare is top notch in Mumbai, so much that Americans are coming here for treatment.  Increase the cost for Americans who come here for helathcare. If after the increase of cost the Americans reduce, the doctors will still have no problems. Other Indian state government ruling parties should also look to improve their respective states/cities. What happens in IT profession in America is not our headache. India should be so much capable that Indians should stop talking about America did this, America did that and so on 24*7. Take a chill pill. America and IT is not the end of the world.

He was in US but had to come to India for renewal in Jan, went back in Feb.

What he must have come for is for some ‘stamp’ in the visa.
Most people who r employed in the US renew in the US. But renewal does not give a stamp (travel document). For that u need to go outside (they were trying to change that).

I concur with the immigration lawyers because it agrees wkith text. where is the support for your interpretation in the text?

 

secition 1.a says it will restrict entry to any h1b who doesn't pay 100k. No exemption for already stamped.

 

section 1b, talks about how on new petitions (both new & renewal)w/o 100k will be denied  but it only applies if the person is outside US, for the next 12 months. 

 

section 1c is the first one that provides exemption, but its a National intrest waiver for important inustries, not based on visa stampting.

this is an extreme example, but it is like saying I am from kanyakumari so why do I care what happened to someone who went to vacation to kashmir. 

 

what as been done, potentionally robs Indians who invested in US to be cut off from it, unless they paid 100k ransom. if you say to that Indian you don't care what happened to you, why should any Indian care about anything that happens in any other state?

All of his documents were stolen in US on a vacation including passport. He had to renew so he probably had to come back for stamping.

lol it’s because it’s not worded as coherently. 

Basically the petition part is also implicit in section 1.a. Read it in full it says “except for those whose PETITIONS r accompanied with 100k…” If the petition part was not implicit, they would have said “except if the ENTRY is accompanied by 100k fee”.

petitions & visas are two different things, you can't ENTER US with just an applied or even approved petition, you need a VISA. The opperative word here is suplemented

 

"....except for those aliens whose petitions are accompanied or supplemented by a payment of $100,000.."

 

this could mean adding or supplementing the 100k requirment for existing petition too. yeah you can say its poorly worded, & it doesn't mean that. But do you realy think a CBP officer who is a pencil pusher cares or even understand such nuances?

That nri knew his/her status in the usa was not secure.

 

Risk and reward.

 

Millions of indians in the middle east live like this. Have investments in india.

 

Many preferred canada despite it being a poorer prospect as path to citizenship was clear.

 

What have dems done to clear green card backlog?
