MonishaSarabhai Posted June 25, 2011 Posted June 25, 2011 Eve-teasing could now land you in jail The Bombay high court has asked the state to consider making section 354 of the Indian Penal Code, which deals with assaults or use of criminal force on women with the intent to outrage her modesty, a non-bailable offence. The high court was hearing a suo-moto petition based on a recent article highlighting the plight of women commuters on trains. “Why don’t you make the concerned sections non-bailable,” a division bench of Chief Justice Mohit Shah and Justice Ranjana Desai observed. “It appears that since it is bailable, police take it lightly. If you make it non-bailable, the police will be required to arrest the culprits.” The bench recommended that instead of waiting for the Centre to amend the concerned legal provision, Maharashtra should follow Andhra Pradesh and Orissa, where a molestation charge is non-bailable. The judges also cited the example of Madhya Pradesh government, which has added a provision to IPC — Section 354A, and has increased the punishment from one year imprisonment to 10 years. The court was hearing a petition highlighting the plight of a woman who was molested on a train. MonishaSarabhai Posted June 25, 2011 Author Posted June 25, 2011 this shold be followed all over india. dont know how much it will help. there have been so many horrible incidents this month alone. after the Rajasthan university campus, howrah (man trying to help the girl was stabbed) and vadodara incidents (guy trying to stop the eve-teasers was killed), here's the latest: Std 10 girl harrased by four youths CHENNAI: A class 10 student and her parents on Friday submitted a petition to police commissioner J K Tripathy seeking action against four persons who entered their house and misbehaved with the girl. According to the police, the girl and her brother are class 10 students of a Corporation School in Egmore and the girl walked to school everyday from her house in Dr Santoshapuram in Egmore, a distance of one kilometre. For the past two months, the complaint said, four persons in their early 20s would stand near her house and make comments and indulge in eve-teasing when she went and returned from school. On Thursday, the girl's mother Tamilselvi decided to file a complaint against the four at the Egmore police station. After she left, the four went to the house where the girl and her brother were sleeping. They beat up her brother and chased him away before misbehaving with the girl. They ran away after she raised an alarm. There is a case in U.P now of a 14 year-old girl being raped and hung to death by four policeman within the police station compound. The very term eve-teasing is by itself a very self-serving concept that seeks to preemptively pardon and even condone men and boys for misbehaving in public. It's a medieval concept that deserves no place in society.

That is a creation by the media/society to make the crimes appear less heinous. @ Monica: There already is a jail tenure and/or fine for most of the crimes that fall under the broad category of what we term as "eve teasing". The current proposal by the HC is to designate these offenses as non bailable.

MonishaSarabhai Posted June 27, 2011 Author Posted June 27, 2011 well about the 'eve-teasing' culture, one theory is that our movies are partly to blame for inspiring these roadside romeos. it is common for the hero to chase the girl even if she is not interested and then in the end she falls in love with him. and the whole 'chasing' bit is supposed to be romantic and sweet. is this true or are we just giving too much importance to the movies.

I hope you understand the difference. What is meant here by eve-teasing is passing lewd comments and literally harassing girls. Eve-teasing in fact is the wrong way of expressing it. Let me give you some examples: A girl returning from college to home in a rickshaw would be surrounded by boys in bicycles/motorcycles talking loudly about her figure in colorful language. Discussing their fantasies about what they would like to do to her if they got an opportunity. Passing unbelievably bad and humiliating remarks loudly right in the middle of the college. Touching, groping, pushing and sometimes even molesting them in buses and even in the middle of the college. Flirting is different. Trying to get their attention is different. But what is being discussed here, is plain criminal harassment.

Ruben lost his battle in hospital on Monday, while Keenan died 11 days ago. Keenan's girlfriend and an eyewitness to the stabbing said her sense of security has shattered. "People stood there watching...did nothing," said Priyanka Fernandes, Keenan Santos' girlfriend. At 11 pm on the night of October 20, Keenan Santos, Reuben Fernandes and five of their friends came out for a paan after having dinner in Amboli Restaraunt in suburban Andheri. They got into a argument with main accused Jeetendra Rana after he allegedly started harrasing Kenan's girlfriend. Rana retreated only to return with 20 friends and stabbed Keenan and Reuben. "Why are we allowing all these criminals to roam freely? Why are we not doing anything about it?" asked Keenan's father Valerian Santos. There is an outpouring of grief and anger on social networking sites. A Facebook page with 20000 fans is trying to build a pressure on the authorities. The tears of the Fernadez and Santos families have dried and have been replaced by anger. The only question they now have is what will the authorities do so that the sacrifice of their children does not go in vain?
