But any such marriage, will be considered void and can be annulled by the court simply because consent is mandatory. In this case, the guy has it on video that he wasn't consenting. In fact, I believe that this video was only the ceremonial marriage. I don't think they could have gotten it registered in these circumstances. On a related note, and another it happens on in India As per our laws, if a guy has a sexual relationship with a girl promising her to marry her in the future and reneges on his word, the girl can charge the boy of rape. I know of a very funny case on these lines. Both the guy and the girl are very well to do. Guy promises girl of marriage, they have a relationship for 3 years. The girl claims that she was promised marriage & couple of their mutual friends support her statement. After 3 years, college is done with, the guy says that they belong to different castes and cannot get married. ( As if that wasn't apparent for the 3 years). The girl's attempts suicide and fails. Thats when her family get wind of the entire episode and try and get the best legal help money can buy. The lawyer they approach advices them to tell the boy and his family that they will ensure he does the time for rape or he'll have to marry the girl. Turns out that the guy and the girl belong to the same caste and that he just didn't want to marry her. Girls parents advice her to forget the whole thing, charge him for rape and move on. Guys parents plead the girl to not press charges and even agree to give in writing that they will not take dowry if she agrees for marriage. The girl, still in love with the guy, 'coerces' the guy into marriage. I hear they're doing quite well now. Have a 2 month old son and the girl has opened a boutique in Bandra from where I bought a waistcoat. Always wanted to ask her, whats the point of getting married when you know that the guy was a cheat and never wanted to marry you. But some questions cannot be asked. Poetic justice? Or is it miscarriage of justice? It happens only in India.

Call it an out of court settlement. :D Initially the girls side was ok with wedding via blackmail, but changed their mind when they found out that the reason the guy had given (caste) was a lie. But the girl still wanted marriage, and marriage she got. The suicide attempt was when all this came to the fore.But her dad could silence the police due to his affluence.

We've all heard of cases where the girl latches on for several years, enjoys the privileges that come with a relationship, and then walks away saying "parents' pressure" or "my astrologer said you'll die within a year of our marriage" or some such nonsense. Any legal protection then? Always wanted to ask her, whats the point of getting married when you know that the guy was a cheat and never wanted to marry you. Spot on. It is mind-boggling.
Brainfade Posted December 3, 2011 Posted December 3, 2011 I was searching for the one at 38 seconds.. that one is epic ( and so is the lassi/shake making guy following him) The cool thing is, no one at the scene seems to be amused and life is going on as if thats a norm. I thought it was tea. It sounded like Malayalam in the background ... must be chaaaayeh! That style is common in the roadside tea shops on Kerala/TN. Edit: We're both right. It does look like a shake/lassi, but the language sounds like Malayalam. Dude's using the Kerala chayeh style. It is remarkable also that no one really thinks much of these amazing showboaters ... it's life as usual for them and the people around them.

Still case is not cleared .If Girl's side changed their mind then how could they press charge:confused_smile:.The girl could had never moved on as long as the case is going.What the Girl's side wanted just to press rape charge and saying earlier girl wanted to marry but now she don't so please charge the boy with rape As far influence is concerned then it is open secret that influential party always win

Any legal protection then? Cricaddict, you're mixing two different things here. By the law of the land, an individual woman cannot rape a guy. In the weird example I cited above the girl consented to any kind of a sexual relationship only because the guy promised marriage in the future. That is the sole reason he could be charged with rape. If the girl had agreed for sex without the promise of marriage, the girl couldn't then press charges against the guy. She is free to ditch him as and when she feels and so is he. What happened here was the girl agreed for a sexual relationship in lieu of marriage later on. When you say the roles are reversed, do you mean that a guy refusing to have a sexual relationship with a girl unless they are married??? Girl: ( seductive body language) cozying up to the guy. "hi" Boy: Nahi. This is not right. We're not married yet. Girl: But I promise to marry you. Nek kaam mein deri kaisi. Boy: I think its wrong, but only because you promise to marry me, I'm going ahead with this. Unfortunately, the above can only happen in Karan Johar movies ( which I like btw) whose title has at least 4 words. There is no legal protection for a girl dumping a guy, rightly or wrongly. And for guy dumping a girl either. And thats how it should be. We don't want the courts telling us who we can dump or asking us to justify why we've dumped someone, as long as everything we did was with complete mutual consent of the partner. PS: Please do not call Astrology as nonsense. Astrology is a science ( happens only in India ).

The law holds that consent obtained under false representation is not valid consent (borrowed from the contracts law I believe). Hence, the law considers that if the consent for sex is obtained by a promise of marriage then if the promise of marriage is not fulfilled in due time, the consent for sex not valid consent. Hence it's rape. Idiotic, but that's the logic. I think girls who decide to sleep with the boyfriend before marriage, do so in full awareness of the possibilities. Women who are over sensitive about such things should just save it for after marriage. I also think cric has a valid point. It applies equally to guys as well. If not for rape, the women should be charged with sexual assault or fraud etc. Or rather, neither should be charged with anything.

There isn't any rationale to make the law 'equal'. What do you mean when you say that a woman should be charged for fraud? Fraud for what exactly? The whole idea is to have minimum court interference in the private matters of two adults. Only when something is without consent/ based on a lie or fabrication should the court interfere.
