Tiger80 Posted January 11, 2013 Posted January 11, 2013 JAIPUR: After the medieval khap diktats in Haryana and Uttar Pradesh, a Muslim community panchayat of Salumbar town in Udaipur has now banned girls from using cellphones and dancing and singing at weddings. The panchayat has also warned couples against eloping as they would be ostracized by the community and a fine of Rs 51,000 would be imposed on them. The diktat has come from Anjuman Muslim Panchayat, a minority community council. The panchayat on Thursday justified the restrictions as an effort to prevent incidents such as the Delhi gangrape and ensure safety and security of women in the community. "We have decided to ban use of cellphones by girls. The decision was taken with the view that cellphones are actually spoiling girls," panchayat secretary Habibur Rehman said. Rehman further added that the panchayat took the parents in confidence before imposing the ban. "Our village had witnessed instances wherein a Hindu girl fled with a Muslim boy or vice-versa. Therefore, before passing this resolution we had taken the families into confidence. They assured us that they will abide by the rules. Likewise, we also sought suggestions from the members of the Hindu community in the village," he added. Rahman said the restrictions should not be seen as a diktat but measures to curb crime against women in the village. The panchayat has also come down heavily on 'love marriages' against family wishes. "A couple cannot get married against the wishes of the family," a member of the panchayat said. Those who elope to get married would be ostracized. "A fine of Rs 51,000 will be imposed on them. The decision was taken with the view that cellphones are actually spoiling girls Quite sexist cellphones these, they spoil only the girls. Besides, Panchayats do not have any such punitive powers. They can only arbiter in disputes and can never carry out punishments nor can they pass judgement on any crimes ( leaving petty thefts/ agricultural thefts etc). All this nonsense about fining 51,000 Rs to those elope and get married is absolutely nonsensical ( yeah, they ran away but would get back to pay your fine) and illegal. Doesn't it contravenes the fundamental right to personal liberty? This secretary needs to be reminded about this. Anyways, I hate saying this, but I agree with Arnab Goswami on one thing. The entire system of panchayati raj/khap etc should come under the scanner. Anyone recollect the case, 2-3 months ago,where a panchayat recently 'sentenced' a woman be beheaded for adultery and then executed her? Some years ago, I was in Udaipur on a holiday and happened to witness the taziya procession on Ashura in that city. I was pleasantly surprised, as a lot of women were also a part of the procession. Its something that I haven't seen in cities in UP.

Shameful. Sexist bastards. And as bad as the men in the village, the elder women in the family are upholding these restrictions as well. Pretty pathetic!

Handing out punishment is something completely different. That too death punishment. And there are many such cases which ahve come to the fore in recent months. The panchayats are quite powerful and socially relevant. Thats the way they were intended to be. But in many cases they have overstepped their authority. They are not a parallel justice dispensing system and they shouldn't assume that even for a second. The state should step in here and act firmly. A poor analogy would be that, a during an IT raid on an office, the IT officer arrests the proprietor for driving under influence. That is what this, and many other Panchayats/khaps are doing.

Out of 3-4 lakhs Panchayats in India how many issue death punishments? Those may be extreme cases and should be stopped but my point is that as long Panchayats are socially accepted by villagers they can't be stopped.

Alcohol is banned in gujarat but look at the amount of people that die from alcohol ( includes many youths) every year. You cannot keep suppressing people. You need to make them understand.
