Becoz in Assembly elections in TN we have had Opposition leaders(whoever has 2nd most seats) even if dont win 10% seats Leader of the Opposition will obviously be allowed from the Cong but from what I know, there will not be any official opposition party if no party in the opposition fails to win at least 10% of the seats.
