Courts don’t pass laws or legalize anything in India. It is the parliament that does pass laws , to your uninitiated cranium. As per current laws, SC didn’t think it can allow the new provisions, so SC has asked the centre to form a committee to look into passing a law. Can you bring same sex marriage before common civil code ? I think if law permits same sex marriage then we should forget common civil code for a atleast a decade.
