Pinki Pramanik's gender test inconclusive Kolkata: The gender of Asian Games gold medalist Pinki Pramanik could not be established at the Barasat General Hospital on Tuesday as it did not have the facilities, and the case was sought to be referred to the better equipped SSKM Hospital in Kolkata. "There was ambiguity in the reports we got. We don't have the facilities for chromosome and hormone tests. We did the ultrasonography, but all the tests could not be done", Chief Medical Officer of North 24 Parganas district Dr Sukanta Sil said after Pramanik's medical tests lasting about three hours. X-ray, scan and blood samples could not be taken because of lack of proper facilities at the Barasat General Hospital, where the athlete was taken. "We are making a plea to the chief judicial magistrate that the case should be referred to the SSKM Hospital. Being the state's referral hospital, SSKM has better facilities. So the tests should be done there", said Sil who headed a seven-member medical team. The report has to be submitted to the court by June 29. Pramanik is in judicial custody accused of rape and of being 'male'. Pramanik, who won the 4x400m relay gold in the Doha Asian Games 2010, was arrested on June 14 after being accused of multiple sexual assault and misrepresentation of gender by a 30-year-old estranged woman who had a live-in relationship with the athlete for two years. The middle distance runner, who had won five gold medals and one silver between 2005 and 2006, officially retired the next year, but there were reports that the athlete was not allowed in a Madurai national meet because of 'excessive male hormones'. http://ibnlive.in.com/news/pinki-pramaniks-gender-test-inconclusive/266878-3.html

Having sex under false promise is rape under Indian laws

Oh yes, I completely agree. There are so many relationships which take a turn for worse after 1-2 years yet the guy cannot break up or change his mind because he earlier promised marriage. A woman's position is still equated with sex

Pinki Pramanik released from jail after 25 days pinki-release300.jpg

Before getting into a car and driving off the 26-year-old said, "I have been framed and the woman is still trying to fix me." That woman is Pinki's 30-year-old live-in partner who has alleged that Pinki is a man who raped her. The retired middle-distance runner was arrested on June 14. The judge at the North 24 Parganas district court, while granting bail to Pinki yesterday, had observed that Section 376 of the Indian Penal Code, which deals with rape could not be applied in the case. He granted bail on a surety of Rs. 5000.

Even as Asiad gold medallist runner Pinki Pramanik fights a legal battle after accused of being a male and arrested for alleged rape, a video showing the athlete completely naked and undergoing tests at a private nursing home has gone viral online. The 29-second clip was reportedly circulated after Pinki underwent a gender verification test at a private nursing home in North 24 Parganas district where the sprinter was taken subsequent to her arrest June 14. "I have heard about the video clip, though I am yet to see it. Those responsible for making the clip must be immediately arrested for such a heinous act. The matter needs to be reported to the police but at the moment Pinki is behind bars and no one from her family is available to file a report," Pinki's counsel Tuhin Roy said.

The way I see it, she is sitting on a gold mine at the moment. Apart from suing the woman who accused her/him of rape for defamation and a bunch of other charges, she has a number of cases against the government including the MMS that was recorded and leaked while in custody. If she ha proper counsel, she should emerge a millionaire out of this.

When was the last time someone won a libel in India against the government?

I have probably never heard of any such case ever going anywhere after the initial hoopla.

I have heard about it and empathize with your family but this doesn't count as libel.
