Fact is this how pakistan fights terrorism. They think they can fool everyone in the world like they use to do in the past.

Shows how difficult its to prove that he is guilty In April this year however, proceedings came to a virtual standstill as special judge of the ATC expressed his inability to conduct the trial of the seven suspects due to security reasons. This came following a terrorist attack on the district courts in Islamabad in the month of March.

Pity those kids and their families. India will obviously be hurt. But imagine what the parents of the deceased kids will be thinking. Just yesterday they lost their kids to terrorism and this is how their country fights terrorism. Also pity initiatives like indiawithpakistan.

The chargesheet in the 26/11 Mumbai attack case that ran into over 11,000 pages had just one paragraph on Lashkar-e-Taiba, the terror organization behind the attacks and scant reference to ISI. According to a book set to be published shortly, the chargesheet also left several other lacunae that thoroughly disappointed many, including Chikako Taya, a former Japanese judge who was on the International Criminal Tribunal for former Yugoslavia (ICTY). Justice Taya studied the Mumbai attack case as part of an effort to see if it can be covered under 'joint criminal enterprise' (JCE), to prosecute those in Pakistan who orchestrated the terror strike under an international tribunal. "(With its flimsy chargesheet) The prosecution relieved the real criminals behind the actual crime. The name of ISI does not figure in the chargesheet and consequentially the name did not figure in the judgment. As it is said, the LeT is also scantily defined in the chargesheet. The terror organization did not draw much indictment from the court," the book says. According to 'Fragile Frontiers: The Secret History of Mumbai Terror Attacks', by Saroj Kumar Rath, when Justice Taya visited the 26/11 attack special public prosecutor Ujjwal Nikam in Mumbai, she was surprised to see that the lawyer in India's most important terrorism case had no clue of JCE, a concept that had been innovatively applied by ICTY recently. "Why was the LeT not adequately dealt in the chargesheet, asked Justice Taya? Nikam answered that 'it has adequately been dealt in the chargesheet'. Justice Taya protested and said only one paragraph in the entire chargesheet was devoted to LeT. Nikam explained that as a criminal lawyer he was well versed in criminal proceeding of the case. As he was out of the investigation team, he did not have much information and the union home ministry might have more information, which would satisfy the quest of his visitor," the book says. The book goes on to raise several questions over the way the investigations into the 26/11 attacks was handled, and the very shallow chargesheet filed in the case. "The entire 11,280-page chargesheet basically dealt with the loss of lives and property in the aftermath of Mumbai attacks. The entire chargesheet is a compilation of the post mortem report of 166 persons, oral testimony of 2,202 persons, detail of loss of property, ballistic evidence of blasts and firing, and details about the materials carried by the terrorist to the attacks sites," the book says. When Justice Taya met Nikam, the book says: "Justice Taya started asking question after question on the role of the ISI, the Pakistan army and the LeT in Mumbai attack. All questions were either deflected or answered in the negative by Nikam. On the question of the LeT and the ISI, Nikam admitted his limitation and asked how he could investigate a matter which came under the jurisdiction of Pakistan." The book is also highly critical of the voluminous judgment delivered in the case, pointing out that it was a compilation of "lofty words and hyperbole, which lacks substance and true wisdom." But to a great extent the blame, the book says, is with the poor evidence presented and weak prosecution.

Sorry he isn't innocent at the moment but an accused. There is more than enough primafacie evidence against him and his involvement in the terror act has been established in the trail of Ajmal Kasab in India and trials of David Headley and Tahawwur Hussain Rana in USA. Indecently both the trials have been completed and the sentences have been carried out or are being carried out. But in the country where the plot was hatched and executed from, the country where all the evidence is, is no where close to completing the trial, worse still the accused who can influence the trial gets bail and you tell me we just need to accept it? says who? We have every right to be outraged and express it and expect the govt of pakistan to appeal against the bail and see to it he remains behind bars.
I understand the concept of bail full well, there are probably many details that the public are oblivious to. He's probably had to go through multiple different authorities and appeal after appeal from judge to judge. People are quick to jump to conclusions. I'm not going to ever change my opinion, you are innocent until proven guilty in a court of law. If there is corruption or a fault in the system, that's another matter. He was given bail, the other suspects were not and have not, so clearly there are details that have not been given.
And are you aware of the details? Do you know how many appeals he has gone through? Lets talk about what we know. Its supposed to a terrorism trail, yet it moves at snail place with many adjournments and no transparency, starting 4 yrs after the crime due to intense pressure from India and West. Accused Lakhvi is a top leader of Lashkar-e-Taiba banned by India, many western nations and PAKISTAN Even from Jail Lakhvi continued to operate (this according to US intelligence sources not Indian) and he also was able to father a child. A judge hearing the case had withdrawn because of the threat to his life. Chaudhry Zulfizar Ali the FIA prosecutor was assassinated. David Coleman Headly, Abu Jundal and Ajmal Kasab, along with audio evidence all implicate him. Btw, this was lakhvis bail plea not the bail plea of others. Have the bail pleas of other beean refused? he is apparently the master mind and main accused. if you you can't prevent him getting a bail. we can only speculate about he others.
Hence why as civilised citizens in the 21st century we should be condemning the law and judge and not picking out on this one individual case because it is so high profile.
Pakistan law is similar to Indian law, yet India was able convict and execute sentence of the accused. So has the US. guess why Pakistan can't? Its not just another high profile case. it is a act of terrorism which resulted in 164 deaths, which in all civilized counties in the 21st century is considered a rarest of rare crime and not just a high profile case.

Pak is not ready to match the voice samples they know that'll seal the deal as far as concrete evidence goes.they won't do it just to safeguard these terrorists,add to that the number of judges changed!!

Just heard updates from TOI, that lakhvis detention has been suspended by a paki court. So the terrorist is gonna be free soon Sent from my iPhone using Tapatalk
he's out of jail, so should be easy to eliminate for raw.
