Nope, the charges were dropped because the 'evidences' were found to be not enough to 'prove beyond reasonable doubt' the convictions. In Mohammad Azharuddin's case, remember, there was not even any criminal charges filed, despite the CBI itself finding enough evidence to indict him. Based on CBI's report, ICC and BCCI banned Azhar for lifetime. Which it conveniently put aside in 2006 when he was honored along with other Indian captains. (Technically the ban was struck down only in 2012 though but BCCI had already sidestepped it). In this case, without even coming up with solid evidence, he was arrested and thrown into jail. And based on a quick 'investigation' by a BCCI officlal, he was banned lifetime. The BCCI basically said the ban was based on evidence by Delhi Police. Now it is this evidence that is found to be insufficient by the Court. Sree must sue BCCI for acting without having proper evidence, and his case is now only getting stronger since there is a precedent where Azhar was let free even after having the CBI evidencing against him.

Very surprised that despite all the brouhaha, Delhi Police couldn't gather any evidence directly indicting him. All the proof that they paraded was a video of an IPL match, then some shopping bills of Sreesanth and that he purchased a blackberry phone. Ridiculous!
Texan Posted July 25, 2015 Posted July 25, 2015 Really? They were tried under MCOCA??? BCCI and Delhi Police must have lost their nuts to have such a weak case. Having said that though - an acquitted man must be treated as an acquitted man. It means he did not do anything illegal. If spot-fixing is deemed to be a legal activity, perhaps a law is indeed to curb such an activity as almost everybody will be in agreement that it is an activity that should not be encouraged. The BCCI though would have a Code of Conduct that explicitly bans such activities. So, if they are indeed guilty of spot-fixing, then the BCCI ban is justified. However, the cricketers wouldn't be out of place if they sued Delhi Police for defamation due to the criminal complaint.

We have heard this term too often in recent past. a part of the judgement "...in view of the huge vaccum of law in this regard in the realm of law, this court is helpless to proceed further under any of the penal statutes," it said.
