Spot fixing case: Cases against Sreesanth, Chandila and Chavan dropped.

Nope, the charges were dropped because the 'evidences' were found to be not enough to 'prove beyond reasonable doubt' the convictions. In Mohammad Azharuddin's case, remember, there was not even any criminal charges filed, despite the CBI itself finding enough evidence to indict him. Based on CBI's report, ICC and BCCI banned Azhar for lifetime. Which it conveniently put aside in 2006 when he was honored along with other Indian captains. (Technically the ban was struck down only in 2012 though but BCCI had already sidestepped it). In this case, without even coming up with solid evidence, he was arrested and thrown into jail. And based on a quick 'investigation' by a BCCI officlal, he was banned lifetime. The BCCI basically said the ban was based on evidence by Delhi Police. Now it is this evidence that is found to be insufficient by the Court. Sree must sue BCCI for acting without having proper evidence, and his case is now only getting stronger since there is a precedent where Azhar was let free even after having the CBI evidencing against him.
Sreesanth and co. Were arrested under MCOCA act connecting them with Dawood Ibrahim. That link was never established . Hence that case was dropped. They filed another cheating case against him. The court asked the Delhi police, " whom did they cheat, you? " lol. That case was also dropped since the Delhi police failed to get any fan to complain against the trio. There is no law against spot fixing as well. It should be noted that bcci haven't revoked the bans since these crooks are let off because there is no law against spot fixing, not because these people are innocent.

The actual words were thus:
Castigating Delhi Police for involing MCOCA, the court said, "the best case could have been under Public Gambling Act, but that also is not prima facie established from the evidence placed on record by the prosecution." "The offence of cheating is also not made out prima facie, even if the entire evidence of prosecution is admitted without formal proof," the court added. The court said, "in view of the huge vacuum of law in this regard it is helpless to proceed further under any of the penal statutes."
Surely it isn't hard for Delhi Police to get one spectator to file a case against Sree and press the argument on those lines, at least for cheating? The court decided that there is not even enough proof for cheating, even if it accepted all available evidence - that's quite a strong statement debunking the strength of evidence that is available against Sree. Further, as far as I know, RR filed a complaint against Sreesanth. RR has a formal contract with Sreesanth - and there is definite breach of it, isn't there? Section 415 of the Indian penal code defines cheating thus:
415. Cheating.—Whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any proper*ty to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do or omit if he were not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to “cheatâ€. Explanation.—A dishonest concealment of facts is a deception within the meaning of this section. Illustrations: (h) A intentionally deceives Z into a belief that A has performed A’s part of a contract made with Z, which he has not performed, and thereby dishonestly induces Z to pay money. A cheats.
Clearly by spot fixing, Sree has not performed his part of contract, and further by partaking that he also brought disrepute to his employer and the league, didn't he? Is it hard for the court to take cognizance of these factors? It appears that it has. But The court explicitly refers to the fact that the evidence, even without testing them, is not enough to indict Sree under any penal statutes. I find it rather it rather damning of the evidence that Delhi Police has, and if it couldn't pass the IPC 415 test, I wonder it could've passed even if there was a law for spot fixing and all that in specific.

But spectators need to file an FIR.
I am pretty sure RR and BCCI can also claim they were cheated since they are his employers and guarantors and also a formal contract exists between them.

I have no idea why people think that sreesanth indeed committed spot fixing in the first place. All they have is him running up to bowl with a towel behind him :haha: Further the amounts (10 lakhs) is a pittance by the tremendous risk and the income earned by Sree anyways. I can understand for someone like Chandila or Chawan those could be big amounts. And indeed a substantial amount of cash was recovered from Chandila's cricket kit (20 lakhs!). But in Sree's case, all it brought out was that Sreesanth purchased some clothes and a blackberry phone :cantstop:

I hope BCCI gets flogged for this. There is no proper process or accountability in how they run. Everything is made up on the go and ignored as they wish. I hope that L0dha committee looking into the other betting probe take a note of this as well and make the BCCI a much more transparent and democratic entity.

BCCI is in a real mess here - the court in no uncertain terms dismisses the so called 'evidence' put up Delhi Police - the MCOCA is not even the basis here - raw evidence itself is considered untenable.

It is further argued that S. Sreesanth had signed the IPL contract for which he was to earn 1 Crore 84 Lacs in the session in question. On 03.04.2013, his account balance in HSBC Bank was Rs.36,23,101/* and his total ATM cash withdrawn for the period April, 2013 was over Rs.10 lacs. In the given scenario, no presumption could be raised that the purchase made by the S. Shreesanth were from the advance received from the bookies or that such expenses were not made from his legally earned income.

http://www.espncricinfo.com/india/content/story/903325.html Please have a read doubters. There is absolutely nothing incriminating him in terms of the 'evidence' presented by Delhi POlice. In fact one of the call records has his so called 'agents' stating explicitly that Sree won't do such stuff.
The evidence was flimsy from the start I said it that time too.Who knows the truth in this Bcci power Game these guys are pawns.

Some people here have misunderstood the verdict. I too had made up my mind about Sreesanth's guilt based on the information fed by the media and my initial reaction was he got away through a loophole. It's not true that he got away due to lack of a law against spot fixing. This Jiju guy had links with the underworld, and had it been proved that Jiju got Sreesanth to do the spot fixing, Sreesanth could still have been prosecuted as being part of the organized crime syndicate under MCOCA. It appears that there's no evidence to show that Sreesanth spot fixed the over. Poor stuff from the Delhi police.

as much as i dislike the monkey boy, I highly doubt that he was a culprit. He always gave his heart and soul when he represented his country. Quite sure he wouldn't give it away for some cheap money.

Though I find clean chit thing laughable and its just lazy job by prosecution, yet I find myself unable to fathom the stupidity of Delhi Police who though purchase of a " blackberry" phone is clinching evidence. Come on Sreesanth has earned enough in legitimate ways to buy 10s of such phones.

BCCI says it has it's own "standard" for accepting evidences. Where were these standards in case of RR, CSK? And worse is that they relied on Delhi Police evidence which has been torn to pieces by the court. Not only that, there is nothing evidencing that Sree was approached by bookies or that he agreed to fix the matches. Jeez, who are the lawyers for BCCI?

Sadly Sree's career is ****ed. Even if he challenges in court and wins, BCCI can always deny his selection in Indian team, no matter even if he takes gazillion wickets in domestic. He should however STILL try and win the court case and rescind his ban, and look for overseas opportunities. BCCI cannot say anything against that - Sree can easily play in the county championship if needed - for weaker sides. He can also try a hand in the CPL if needed. Just to prove a point to the BCCI.
