I am pretty sure if they were disqualified, the state would be held responsible for taking retributive punishment for protesting and all usual suspects will do RR until the cows come home. so, iIt is a case of a taking a bitter pill, in this case, for the government . Though if they fail in Asian games (likely), lot of 'told you so' will surface as if it makes Brij Bhushan innocent.

No it makes the selective process unprofessional, as is in most cases of Sports ministry. Only courts can pronounce if somebody is innocent or guilty.

Shashi tharoor is not in power. Delhi police is under central government . It takes lots of guts for Delhi police to accuse a sitting mp that too in a case which is very much public.
