He is meat with energy in it, I'd rather use him than kill him. As i said, India can easily take a page out of the US circa 1920s and start chain gangs. We can always get these scumbags to go build roads in our border regions and keep digging irrigation channels. I dont like the idea of execution because : a) it is a waste- i'd rather use the guy than throw him into the dustbin b) it is not a foolproof justice system and death penalty in a non-foolproof legal system equates to the eventuality of execution of innocents.

Raghav_12 Posted September 24, 2013 Author Posted September 24, 2013 Well, off late I am seeing Indian system's rejuvanated love for Death Penalty.Our president seems to be in hurry to get rid off all inmates awarded death penalties and rejecting mercy pleas dozen at a time. Yesterday, I read bus driver who had mowed over 9 people dead in Pune last year has been given death penalty. Now there is very little doubt that what that guy did was in fit of insanity without anykind of animosity with the people he killed. There is also little doubt, though very unfortunately, that this penalty would act as the deterrent for a person who get into similar fit. World-wide there is definite shift away from death penalty. Many of them made changes in lawbooks to get it stopped while many others stopped carrying out death penaties without declaring it openly. All countries in EU don't practice death penalty and you can't be member of EU if you practice it. Main rationale put forward towards abolishment of death penalty is, there is no prrof that death penalty actually works as deterrent. Rather it devalues human life in society leading to increase in crime of murders. Abolitionists bring example from American states where states those have banned death penalty completely have lesser crime rate than some other states like Texas where death penalties are really rampant. I personally believe other than very-very few cases where keeping a convict alive would lead to greater dangers, death penalty should be done away with. It is not in line with the basic principal of justice which is reformation of human being. It is more like revenge than justice. The death penalty given to Pune bus driver, which had prompted me to initiate this thread, has been set aside by High Court. HC found that session court was so much in hurry to send person to gallows that they didn't even follow set procedure. This is anyway an increasing trend in India. Though this could very well be temporary reprieve to convict, yet it highlights few things. The Court ordered that Mane be produced before the trial court in Pune on October 15. After the Judge hears him on sentence, he would pass an order on the quantum of punishment to be awarded to him, the bench ruled. His lawyer JD Mane pleaded that the trial court had not considered the argument of accused on the sentence. On the other hand, prosecutor Madhavi Mhatre argued that the defence counsel had pleaded before the trial court on this aspect. However, this was not reflected in court record. On April 8 this year, the trial court had given death sentence to Mane, saying the crime committed by him was "the rarest of the rare" as he had killed people by running them over, fully conscious of the consequences of his act. The Court had said that Mane had not dashed the bus against any building on the roads but targeted people to kill them. Mane was held guilty under sections 302 (murder), 381 (theft of employer's property), 307 (attempt to murder) and 324 (voluntarily causing hurt by dangerous weapons or means) of the Indian Penal Code. Mane had hijacked a state transport bus from Swargate depot here on the morning of January 25, 2012, and mowed down nine persons, injuring 37 others in a nightmarish ride on the city streets that sent shock waves in the area. People like these are not humans...they are a different species. We as the human specie need to fight species that are a threat to us. These species are not like the various other flora and fauna on the planet. No other species on this planet is a threat to human beings directly. They don't sit in waiting and prey upon us generally. But when some of them, ex - serial man eating big cats, do then we kill them to protect our own. In the same breath when an individual of a species which is not human (clearly that b@stard is no human) commits a crime like the article states, we as a society have a duty to our children and our society at large to protect ourselves from such a specie. Terminate it! In a ghastly crime such as this, hoping for that individual to reform is a risk just not worth taking.

Those can be politically influenced but can not be corruption influenced.

rixxuu Posted September 25, 2013 Posted September 25, 2013 death penelty is a like for like penelty for the most extreme crimes, its main aim is not detorence but it is justice , detorence is a by product. the courts decide the level of punishment according to the magnitude of crime and the authenticity of evidence . there are lot of examples where u just cant give a punishment less then death , that would be injustice for example ajmal qasab, saddam , dehli gang rapists to name a few.

He even boasted of dumping women and children into pits and dropping burning Tyres over them . Even though he has been sentenced to life imprisonment , he has been on perpetual Bail on one pretext or another thanks to his political masters.
Precambrian Posted July 30, 2015 Posted July 30, 2015 Death penalty inIndia is given to the most rare of rarest cases, after unbelievable amount of steps. So there must be something in that. Hence not against capital punishment in INdia.
