Oversimplification on your part. If all these contracts did not go to these families would other not step in.

 

India is a big country with many able folks who can do the job. Time and again it cannot be few families.

Yes it covers monopoly. In fact the Competition Act replaced the Monopolies and Restrictive Trade Practices Act.

 

The definition of monopoly is vague. The term used legally is dominance. In India, its not Dominance but its abuse that is prohibited.

 

From my limited exposure from reading about cases in the mid 2000s, when the courts tried to define monopoly in a certain industry the firms argued how theirs is a niche category and how they are pioneers in those categories etc. Its a slippery slope.

Actually if you hold a sizeable minority of share and form a cartel with few others in the industry against the rest, you will face punitive action under the Competition Act.

So if for example Jio holds more than 50% of market share and get favorable treatment from govt. which is not offerd to Bharati Airtel potentially they can be declared a monopoly.

If the term used is dominance, would market share greater than 50% not constitute dominance?

Somebody can raise a PIL or a hero judge can go suo moto into the issue of awarding contracts, if they see illegalality. Simply by saying it like RaGa does or in some inane SM video , doesn’t make it reality. Congress has no credibility in claiming corruption on BJP.

This s not about congress. It is about one family controlling 100% of a sector. A text book monoply.

RaGa or opposition goes mum in parliament when they are challenged on their lies. I want them to make such allegation on floor of house or have balls to speak such thing in parliament. All the opposition MPs , come out of parliament and start lieing to people. Parasites they are living on gullible Indian people.

In the scenario you say, yes.

They can be declared dominant even if they get no preferential treatment.

 

A real example ( going to leave out names) is a biscuit brand belonging to an FMCG giant that introduced 'healthy' biscuits into the market in the early 2000s. Since aside of herbal/chooran distributors, this FMCG company was the only one which bought a specific ingredient which grows in limited quantities in the Nilgiris. They booked an amount for 2 years. Thereby killing any scope of domestic competition. The new comers in the space would have to source this from Africa, which was expensive. 

 

The Court had a tough time on deciding if the company abused its dominance, because the main argument by the FMCG company was that they are the ones who have created this market and are doing the bare minimum to keep the brand alive. So 'market share' becomes subjective. Which market do you want to calculate the share in? All biscuits which include Parle G? All health supplements/food which include say whey protein? Or a new category health biscuits?

Yes it could. Its category/industry dependent.

 

There are cases where a market share of 16% makes for a dominating command over the market.

But the thing is, being a 'dominant' company is not a crime. Its abusing that dominance which is.

Haha. What about the few families who control the poor farmers, and their crops, and their hard-work money? Why do middleman who don't contribute in production keep such large hold? Why can't poor have freedom to sale their crops to the market?

Such thread shows the bankruptcy of ideas. Instead of finding solutions for poor people, it is why XYZ is earning? It speaks of only jealously and envy. It is anti-industry, anti-technology, backward mindset.

 

And this is not just about Adani, it is related with business people who are always unfairly seen with contempt. No wonder our best talents keep moving away from the country.
