1983-2011 Posted August 6, 2013 Posted August 6, 2013 Muslim clerics express anger over Durga Shakti Nagpal's suspension LUCKNOW/NEW DELHI: Several Muslim clerics have lashed out at the UP government for suspending IAS officer Durga Shakti Nagpal, slamming SP's attempts to link the decision to the demolition of a mosque wall and asserting that the young officer was victimised for taking on the sand mining mafia. The progressive Jamaat-e-Islami roundly criticised the Akhilesh Yadav government for giving a communal colour to the political decision. "It is wrong to use Islam and a mosque as a shield for doing this. There is a clear attempt at implicating the Muslim community in this issue," Salim Engineer, national secretary of Jamaat-e-Islami Hind, a political outfit of the clergy, told ET. Maulana Yasoob Abbas, spokesman of the Shia Muslim Personal Law Board, demanded that suspension be immediately revoked and Nagpal be allowed a free hand. The decision to suspend her had nothing to do with the mosque but her drive against the illegal sand mafia, he said, adding even the DM of Gautam Budh Nagar had given a report in her favour. Rashtriya Ulama Council national president Aamir Rashadi Madni said: "The demolition of the masjid wall was as per the lekhpal's report and the SP government is trying to make it into a Muslim issue." "The government wants to show that Muslims want that an honest officer be suspended for the construction of a mosque. Nagpal has been used as a sacrificial goat," he said. Engineer also sought to know from the state government what action it had taken against officials in areas such as Ghaziabad and Pratapgarh, where communal clashes had erupted over the past year. Similarly, Madni asked why the state government did not show equal enthusiasm for building the mosque at the site instead of fanning communal tensions. SP can, however, draw some comfort from some voices of support. The conservative Jamaat-e-Ulema, led by Arshad Madani, the proctor of the Deoband seminary in UP, supported suspension. Its spokesman Maulana Abdul Hamid Naumani said, however, that while suspension was correct, efforts to play politics over the issue were not. Naumani said neither SP nor Congress had been great friends of the Muslims. zubinpepsi Posted August 7, 2013 Posted August 7, 2013 'Don't want to say what family Durga comes from' : UP minister Ahmad Hasan LUCKNOW: Giving IAS officer Durga Shakti Nagpal's case the ugliest spin yet, UP's cabinet minister for health Ahmad Hasan on Tuesday launched a bitter invective against Nagpal and called her "immature," saying she failed to discharge her duties and that her actions discredited and dishonoured the entire IAS lobby. The minister, giving vent to what is probably the collective emotions of the cornered but combative Samajwadi Party government, was speaking at a dairy development related event at the chief minister's residence. Even though the state has, so far, failed to prove any charges against the embattled officer, Hasan said Nagpal lied about not demolishing the wall surrounding a wall in Kadalpur village and said she should have tendered an unconditional apology for her actions, to the state government. Nagpal, though widely discussed, has never, since she was placed under suspension on July 27 on allegations of not following administrative procedure in demolishing a wall, made a public statement or contested the charges levelled against her. In an eyeball-to-eyeball battle where the state has refused so far to blink, Hasan said, "These days, the media is assailed by Durga- phobia (sic) and her case is being highlighted unnecessarily. No one has bothered to go to the village, speak to the residents or the village pradhan. I am saddened by what I read in the papers and see on TV. We don't want to be petty and say what family she comes from. If you knew all the details, you would not support her." What came as a bigger shock was Hasan's outright denial that the local intelligence unit report, which neither names Nagpal, nor the Sadar tehsil where she was posted as sub-divisional magistrate, was the basis on which the government placed her under suspension. Only a week ago, a day after TOI reported that Nagpal was exonerated by the DM in his report, Akhilesh had named the LIU report and said the officer was suspended on ground of inflaming communal tensions. Defending the CM, Hasan said, "I was there with the CM. I heard him say that reports by the DM and LIU were among the others the state had received. These reports suggested communal tensions were anticipated as a result of Nagpal's actions. Hence, she was suspended." Himself a former policeman, Hasan also took on the IAS lobby saying the same people who were now taking up for Nagpal were silent when "a pilot was made cabinet secretary" in the previous regime. "No one said a word then. Now, however, people are out to take advantage of the CM's decency." Meanwhile, Akhilesh, who refused comment on the matter, said the government was working hard to get to the bottom of the matter. "The government is doing its work. Should we not punish the people who are doing poor work? The officer has been served a charge sheet and proper procedure will be followed to get to the bottom of things in that case. We are as committed to finding the truth as everyone else." speechless

Detonator Posted August 7, 2013 Posted August 7, 2013 Illegal sand mining: National Green Tribunal bans sand mining across the country NEW DELHI: The National Green Tribunal on Monday ordered a stay on all sand mining activity in the river beds, which do not have requisite environmental clearance. The environmental court's interim order on Monday was given on a petition filed by the National Green Tribunal Bar Association in response to the suspension of IAS officer Durga Shakti Nagpal, who initiated a drive against illegal sand mining Gautum Budh Nagar district of Uttar Pradesh. The petition raised the issue of "illegal and impermissible mining activity" in Uttar Pradesh, particularly on the banks of the Yamuna, Ganga, Chambal, Gaumti, Revati and other rivers. "Uttar Pradesh state authorities have failed and/or have intentionally not taken appropriate legal action against the project proponents and thus have abetted and wilfully connived in allowing such illegal sand mining to take place in complete violation of environmental and other applicable laws," the petitioners alleged. A bench headed by tribunal chairperson Swatanter Kumar decided to widen the scope of the petition to the entire country as it "raises substantial environmental issues and questions arising directly from the implementation of the Environment Protection Act, 1986 and other Act." Monday's interim order by the green court doesn't go beyond the Supreme Court ruling of February 2013, instead focuses on its implementation. "This removal of minerals from the river beds is causing serious threat to the flow of the river, forests upon river bank and most seriously to the environment of these areas," the order said, adding that "besides violations of law, the mining activity is being carried out on a large scale, causing state revenue loss which may be running into lakhs of crores of rupees." The green court reiterated that the Supreme Court's February judgment making environmental clearance mandatory for mining of minor mineral, including sand from river beds even areas less than 5 hectares. The apex court ruling was clear that sand mining on either river bank, up stream and in stream is a cause of environmental degradation and threat to biodiversity, therefore required monitoring and regulatory oversight. The Supreme Court ruling has been opposed by several state governments such as Maharashtra and the construction lobby, who see mandatory environmental clearance as a hurdle. The petition before the green court argued that a major portion of the sand mining activity is carried out with any license or clearance from the environment ministry or state environmental impact assessment authorities. All these mining activities are in violation of the country's green laws--the Environment (Protection) Act, 1986, Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) act, 1974. The green tribunal has ordered all deputy commissioners, superintendents of police and mining authorities in all states to ensure compliance. The next hearing on the case is on August 14. The environment ministry plans to approach the Supreme Court to clarify the process for according environmental clearances to minor mineral mining projects below 5 hectares. It is also sending an inspection team to review illegal sand mining in Uttar Pradesh following the uproar over Nagpal's suspension. "Already issue of licenses for sand mining is very strict and illegal sand mining has to be stamped out with an iron hand. I intend to find out the facts, may be look at the issue by sending a team on a fact finding mission, to find out what the correct facts are. It is not a party issue, but an issue of the nation. We will crackdown on illegal sand mining," environment minister Jayanthi Natarajan said. It's a good move but not sure whether the mining will really stop.
