The bill is not passed, so there is no problem for now. Later, the visa renewal process might have some clauses and it will not be easy to renew. It's better to apply for PR unless he has no plans of staying back.

No one gets deported like that. If the company has already applied for his green card, then he stays and gets his Green Card when his EB2/EB3 dates go current. Currently the cases are backlogged and people are waiting for over 10 plus years in some categories of India. If the company hasn't applied and his work permit is about to come to an end, there are chances that company might not renew for him and tell him "Thanknyou for your service. " If work permit is expiring and GC has been already apllied, he can look for another employer.

Indian category, especially Employed Based 3rd category needs judicial change as people have bee waiting for green cards from 12-15 years. These people have paid a lot of money to INS(if anyone remembers that name) and then to (USCIS) from last 2 decades. Also it is ridiculous how some people sponsor the family and kids and the wife gets green card in less than a year, but some people like the ones in EB3 category have had to wait 10-15 years to get the green card, even though they are more loyal to the country than the ones who just entered the country just 3 months ago and have a GC already. There is a judicial change needed. And I hope something positive is done for those who are stuck waiting for so long.

The current date is 2008 it been like that since Obama became president the first time.

It's not about proving loyalty, but how humane the policies are towards families/children.

I am not saying they should wait 10+ years but it is totally inhumane to make people wait for 15 years while others come in late and get in a jiffy. Just not fair to me to those people. These same people do not travel back home in fear for a long time because they feel they might be held up at the airport. Even after working for 10 plus years they do not have a gc and the new comers do, there is something clearly totally wrong with such system and hence needs a judicial change. G_B_ 1

Yep...because let us say someone graduates and works on OPT for 2 years,he will not be meeting that 130K criteria because don't think companies will hire a 2 year experience guy for $130K per year unless he is really extraordinary.

I was in San Francisco a couple of years back...Went to buy booze one evening and there were 3 Indian students(all from Andhra/Telangana ) working there....so I casually asked which university....they themselves laughed saying that is was a crappy university that no one has heard of. Apparently there were 30 of them who came at the same time....also none of them seemed like they were from affluent families....all with the dream of getting a degree and scoring a H1 and making money. Most of the students that fall within the std. deviation will not study for an MS if they would not be allowed to reside and settle. maniac and G_B_ 2
