Geneva conventions only apply when both are officially at war which both sides have not declared. Its only escalated situation at LOC so Pakistan can keep him as long they want. There is no such hard-n-fast rule (7 days), it is on paper, which countries can violate based on their clout. India has better clout atm with UN/International than Pak. . As explained earlier, Geneva conventions is for enemy combatants, not just PoW. War situations are assessed based on ground conditions.
