The "intention" of the franchise owners can never be proved. They can simply claim that they found better quality players elsewhere.

 

Also, what action can Moeen threaten a franchise with? What is his power/capacity to do anything?

How many Pakistani players played hundred before IPL owners entered? This question should be asked from them.

I don’t think labor laws in places outside India will support this .. discriminating against national origin or nationality is probably against some law there .. in India it’s easy to quote national security threat.. what national security threat can they quote there ?  IPL is an extension of the BCCi extension of the BJP (ruling party) .  So yeah this won’t fly outside India .

Assuming labor laws are even applicable to these freelance gigs, proving discrimination in auction strategy is impossible. Owners can say they think Pakistanis are not good enough in English conditions. What then? It's not as if Pakistan is the best T20 team anyway.

ECB would be stupid to legally pursue this. That will only push Indian money away from that failing tournament. The best ECB can do is lip service about inclusivity.

How will it be proven? No one is obliged to pick players from any country (except home country). How many Italians are there in the Hundred?

This has nothing to do with UK labour laws which are not applicable. Most of the people they are talking about are not UK citizens or resident here. Pakistani citzens do not have a right to work in the UK. 

This is a sporting auction in which no one from any country  has an automatic right to be picked. An auction is discrimnatory by its very nature.

In addition the actual auction is on March 12 and people are already moaning about something that is yet to happen.

Correct and most of the people as Pakistani citizens have no right to work in the UK anyway.

The ECB and The Hundred already discriminate against Irish players men and women  who have the right to work in the UK under an reciprocal agreement by classifying them as overseas players in the county championships and the hundred .

ICC and ECB rules do not override the Laws of England and Wales . 

As yet no Irish player has taken the ECB to court probably due to the expense .

Irish players have a right to seek work in the UK. It doesn't mean a private employer ( which is what counties are) is under any obligation to offer them a contract by virtue of their nationality. Counties regularly employ foreign nationals including Indians and Pakistanis. Once offered a contract they then have to apply for work permits which is where the compliance to UK laws is checked. Actually an Irish player Eoin Morgan captained England to a world cup win in 2019 !

Ecb has started looking into this, may be ecb has sent out a formal communications to all the teams regarding this matter.

 

but on labour law, is that not applicable to eng/uk players/citizen only. if 2 countries does not have agreement where workforce can/is eligible to work in both countries then only such law applies , these things comes under mutual treaty ?

Let's say no discrimination was there, realistically which pak player would they have their eyes on? I can name multiple other players who can do a similar job or a better job. Babar/Rizwan has proven that even their most profilic players are not worth picking
